Terms of Service

These Terms of Service (“Terms”) govern access to and use of the websites, applications, and services (the “Service”) provided by Tepali, a product of Lotus Artificial Intelligence Corporation, a Delaware corporation (“Tepali”, “we”, “us”). By using the Service you agree to these Terms and to our Privacy Policy.

Who uses Tepali

Tepali is an operating platform for medical spas and aesthetic practices (each a “Practice”). Practices and their staff use the Service to run scheduling, client records, payments, messaging, and marketing. Clients of a Practice may interact with the Service when they book online, complete forms, pay, or exchange messages with the Practice.

Accounts

A Practice is responsible for the accuracy of the information it provides, for the activity of its staff on the Service, and for keeping login credentials confidential. Staff sign in with a one-time passcode sent to their phone. Tell us promptly at founders@tepali.com if you believe an account has been accessed without permission.

Practice responsibilities

Each Practice is responsible for its own clinical, legal, and regulatory obligations, including licensure, informed consent, medical recordkeeping, HIPAA and state privacy law, advertising rules, and the lawful collection of consent before contacting clients. Tepali provides software; it does not provide medical services, medical advice, or legal advice.

Payments

Subscription fees are billed monthly in advance and are non-refundable except where required by law. Card payments accepted by a Practice through the Service are processed by our payment processor under its own terms; Tepali does not store card numbers. A Practice may cancel its subscription at any time, effective at the end of the current billing period.

Text messaging (SMS) program terms

Program description. Practices that use Tepali may send SMS messages to their clients about the client’s own appointments and care, such as booking confirmations, appointment reminders, aftercare instructions, and replies to messages the client sends. A Practice may also send occasional promotional messages, but only to clients who have separately opted in to marketing texts. Tepali also sends one-time login passcodes and account notices to Practice staff.

Opt-in. Consent to receive texts is never a condition of booking or purchasing. A client opts in by checking the optional, unchecked-by-default consent box on a Practice’s online booking page, by giving the Practice permission in person or by phone, or by texting the Practice’s number first. Staff opt in by entering their phone number on the login screen.

Opt-out. Reply STOP to any message to cancel. You will receive one confirmation message and no further texts from that number unless you opt in again. You can also ask the Practice directly to stop texting you.

Help. Reply HELP to any message, email founders@tepali.com, or call (908) 367-0540.

Frequency and cost. Message frequency varies by Practice and by how often you book. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.

Privacy. Mobile numbers and opt-in information are used only to deliver the messages you agreed to receive. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy.

Acceptable use

You may not use the Service to send unsolicited messages, to contact people who have opted out, to upload unlawful content, to interfere with the Service, or to access data that does not belong to your Practice. We may suspend accounts that violate these Terms.

Data

Client records a Practice manages through the Service belong to the Practice. Tepali processes them on the Practice’s behalf as described in our Privacy Policy and any business associate agreement in place. A Practice can export its data and can request deletion when it leaves the Service.

Disclaimers and liability

The Service is provided “as is”. To the fullest extent permitted by law, Tepali disclaims all warranties and is not liable for indirect, incidental, or consequential damages, and our total liability for any claim is limited to the fees the Practice paid to Tepali in the twelve months before the claim.

Changes and contact

We may update these Terms from time to time; the date at the top reflects the latest version. Continued use of the Service after a change means you accept the updated Terms. Questions: founders@tepali.com.
